1. Acceptance of Terms

By accessing or using Texting Blue ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Texting Blue provides a cloud-based platform that enables teams to send and receive iMessages through a shared inbox, REST API, and third-party integrations. The Service includes a web dashboard, API access, webhook delivery, and integration connectors.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep your account information up to date. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Service to send spam, unsolicited messages, or bulk marketing without recipient consent
• Violate any applicable laws, including telecommunications regulations and anti-spam legislation
• Attempt to gain unauthorized access to other users' accounts or the Service's infrastructure
• Use the Service for any fraudulent, abusive, or deceptive purposes
• Interfere with or disrupt the Service or servers connected to the Service
• Reverse-engineer, decompile, or disassemble any aspect of the Service

5. Subscription and Payment

The Service is offered on a subscription basis. You agree to pay all fees associated with your selected plan. Fees are billed in advance on a monthly or annual basis and are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Your subscription will automatically renew unless you cancel before the end of your current billing period.

6. Free Trial

We may offer a free trial period for new users. At the end of the free trial, your account will be converted to a paid subscription unless you cancel before the trial ends. No credit card is required during the trial period.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Texting Blue Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Your use of the Service does not grant you ownership of any content, code, data, or materials you may access through the Service.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of all messages and data you transmit through the Service. We process your data only as necessary to provide the Service and as described in our Privacy Policy.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime or service interruptions beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by law, Texting Blue Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

11. Termination

We may terminate or suspend your account at any time for violation of these Terms, with or without notice. You may cancel your account at any time through the dashboard or by contacting support. Upon termination, your right to use the Service will immediately cease. Data retention after termination is governed by our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.
